Access and Connection Charges

The service is accessed via the web application or the mobile application that our servers contact via an internet connection. You bear the costs for the connection yourself. Please note that the mobile application communicates regularly in the background with the service when the location is switched on. This can result in very high costs depending on your mobile phone contract. This also applies in particular to roaming abroad.

Use Restrictions

The use of the service is subject to the legal framework. Use for illegal purposes is not permitted. Use that affects the service for other users is also not permitted.

The service allows your location to be continuously recorded and passed on in the background. Since incorrect collection or disclosure of your location data could negatively affect your privacy, we exclude use by underage users.

Furthermore, we only allow the use of the mobile application on devices that belong to you and that only you use.

You can only use our applications in situations in which you do not have to concentrate on something else (e.g. driving on the road).

Your Rights

We grant you a personal, royalty-free, non-transferable, non-exclusive, revocable and non-sublicensable license to access the service.

You can stop using the service at any time.

Your Duties

You may not change the software that implements the service without our written consent.

Access to your account is protected by a password that you must keep secret. In your own interest, you should use a secure password and report to us if you suspect that you have lost your password.

Warranty and Disclaimer

We offer the service free of charge and without commercial interest. Our goal is to obtain location data for research purposes from users who knowingly want to pass on their personal data to us. In addition, we want to make the work of our students accessible to a wider audience in order to further increase their motivation and interest in the diverse topics of computer science.

Since we do not earn any money providing the Service, we do not make any specific representations regarding the Service. In particular, we do not make any assurances about the functions, availability or reliability or the suitability of the service for certain purposes. Furthermore, we always only provide the service in its current form.

To the extent permitted by law, we exclude all warranties. To the extent permitted by law, we continue to assume no responsibility for lost profits or income and are not liable for any loss of data. Furthermore, we exclude liability for indirect damage and consequential damage that could arise through the use of the service, insofar as this is legally permissible.

Privacy

The type and scope of the processing of your data through the use of the service are described in our data protection declaration. Please read the data protection declaration carefully, as by accepting these terms of use you consent to the processing of your data as described there.

Security

We strive to make the service safe for all users. To do this, we update our computer systems regularly and encrypt communication with the service via HTTPS. Unfortunately we are not able to guarantee security.

Termination

We intend to operate the service for a longer period of time. However, we reserve the right to discontinue the service at any time. As far as we can, however, we will announce this in advance.

Changes

We reserve the right to change the terms of use of the service. If we do that, we will try to inform you in advance of this via email and / or message entries in the service.

Severability Clause

If any provision of these Terms of Use is unenforceable, it will be deemed separable from the remaining provisions and will not affect the validity and enforceability of the remaining provisions.

License Notices

The basis of our map display and our address resolution are the data of the OpenStreetMap, which are available in accordance with the Open Data Commons Open Database License (ODbL) by the OpenStreetMap Foundation (OSMF) (© OpenStreetMap contributors). The map data is visualized with the help of a library for image generation from Locoslab GmbH. Addresses are also resolved using tools from Locoslab GmbH. Further information on the libraries used can be found in the settings of the Android app and at the bottom of the web application.
